CONTROVERSIES

In November 2009, Maroga’s contract as Eskom CEO ended amid conflict with the Eskom board. He later filed an R85 million lawsuit against Eskom, claiming wrongful termination and demanding compensation or reinstatement. The board accused him of “failed performance” and dishonesty, citing lack of plans to close Eskom’s funding gap and renegotiate long-term contracts. A court later ruled that his termination was unlawful, because he was not given a proper opportunity to respond to performance-related allegations. Despite getting that judgement, the court did not reinstate him, citing a breakdown in trust with the Eskom board.
After being fired, he nevertheless received a R2.3 million performance bonus, which became a point of contention in court. He was also awarded millions of rand in Eskom shares (2.9 million shares, eventually worth about R9 million).
